Can I still get cost segregation benefits on a build?

Ownership is what enables cost segregation, so yes in principle. The critical variable is the placed-in-service date, since accelerated depreciation applies to the year the property is available for rent. A build that slips past December 31 moves the deduction into the following tax year. Discuss timing with your CPA before committing.
