Spousal Hours and Material Participation

A surgeon working sixty hours a week cannot realistically log 100 hours on a rental property. Their spouse frequently can. For married couples, that fact often decides whether the entire strategy is available, and it is one of the most useful and least discussed provisions in this area.

The rule in plain terms

For purposes of the material participation tests, participation by a taxpayer's spouse is generally taken into account, whether or not the spouse has an ownership interest and whether or not the couple files a joint return.

The practical translation for a two income household where one partner has more available time: the hours that count are the household's hours, not just the higher earner's. What this looks like in practice

The competing participation point still applies

Under the 100 hour test, no other individual may participate more than the taxpayer does. That includes a property manager or a cleaner, which is why a full service management arrangement can defeat the test even when a spouse is doing meaningful work. The distinction from real estate professional status

Real estate professional status works differently. Its requirements, including more than 750 hours and more than half of personal services in real property trades or businesses, are generally applied to an individual rather than aggregated across a couple. That is a meaningful difference and it is a common source of confusion.

Documenting a household arrangement

  1. Log by person. Record whose hours they are, not just how many.
  2. Keep the evidence in that person's name where it naturally occurs: their platform account activity, their email and text threads with vendors, their receipts.
  3. Be realistic about the split. A log showing the busy spouse contributing eighty hours a year is fine. One showing them contributing an implausible amount is not.
  4. Track vendor and manager hours too, since they are part of the competing participation analysis.
