The authority, plainly stated
The provision is Treasury Regulation 1.469-1T(e)(3)(ii)(A), which excludes from the definition of rental activity an activity where the average period of customer use is seven days or less. This is not an aggressive reading of an ambiguity. It is an explicit exception in the regulation, and the consequence is that the automatic passive characterization applicable to rental activities under Section 469 does not attach.
From there, the ordinary material participation analysis applies. Most owners rely on the test requiring more than 100 hours with no other individual participating more, which is one of seven tests in the regulations.

- Depreciation position. An engineering based cost segregation study with documented methodology, land allocation, and a supportable placed-in-service date.
